Definitions

Cards Center: Cards Center, located in Hulst, registered with the Dutch Chamber of Commerce under number 80699502.

Customer: The party with whom Cards Center has entered into an agreement.

Parties: Cards Center and the customer collectively.

Consumer: A customer who is a natural person acting in a private capacity.
Applicability of General Terms and Conditions
These terms and conditions apply to all quotes, offers, services, orders, agreements, and deliveries of products or services by or on behalf of Cards Center.
Parties may only deviate from these terms if they have explicitly and in writing agreed to do so.
Parties expressly exclude the applicability of any additional or conflicting general terms and conditions of the customer or third parties.
Prices
All prices stated by Cards Center are in euros, inclusive of VAT, and exclusive of additional costs such as administrative fees, levies, travel, shipping, or transport costs, unless explicitly stated or agreed otherwise.
Cards Center reserves the right to change the prices of its products, as displayed on its website or otherwise communicated, at any time.
Price increases due to unforeseen cost increases of products or components, which Cards Center could not have reasonably foreseen at the time of the offer or agreement, may lead to price adjustments.
In case of a pricing error, Cards Center reserves the right to cancel the sale of the affected item, resulting in a refund to the consumer.
The consumer has the right to terminate the agreement due to a price increase as described in section 3, unless the increase results from legal regulations.
Payments and Payment Terms
Cards Center may require a down payment of up to 50% of the agreed amount before entering into the agreement.
The customer must pay any outstanding amounts within the agreed number of days after delivery via Klarna.
Payment deadlines are strict. If the customer fails to pay by the due date, they are automatically in default without the need for a reminder or formal notice from Cards Center.
Cards Center reserves the right to make delivery contingent upon immediate payment or the provision of security for the full amount of the services or products.
Consequences of Late Payment
If the customer fails to pay on time, Cards Center is entitled to charge statutory interest:

2% per month for non-commercial transactions.

8% per month for commercial transactions.
Interest accrues from the date of default, with partial months counted as full months.
In case of default, the customer is also liable for extrajudicial collection costs and any compensation for damages.
Collection costs are calculated based on the Dutch Decree on Compensation for Extrajudicial Collection Costs.
Cards Center may suspend its obligations until the customer fulfills their payment obligations.
In case of the customer’s liquidation, bankruptcy, seizure, or suspension of payments, all claims by Cards Center become immediately due and payable.
If the customer refuses to cooperate with the execution of the agreement, they remain obligated to pay the agreed price to Cards Center.
Right of Reclamation
If the customer defaults, Cards Center is entitled to reclaim unpaid delivered products.
Cards Center exercises this right via written or electronic notice.
Upon notification, the customer must immediately return the products unless otherwise agreed.
The costs of retrieving the products are borne by the customer.
Right of Withdrawal (Consumers)
A consumer may cancel an online purchase within a 14-day cooling-off period without providing a reason.
The cooling-off period begins the day after the consumer receives the last product from the order.
If the right of withdrawal is exercised, the product must be returned with all accessories and, if reasonably possible, in its original condition and packaging.
The consumer must notify Cards Center of their withdrawal via info@cards-center.nl or the customer service section on www.cards-center.nl.
The consumer must return the product within 14 days of notifying the withdrawal; otherwise, the right lapses.
Refunds will be processed within 14 days of the return being registered.
By purchasing digital products, the consumer waives their right of withdrawal.
Fair Purchases
Cards Center promotes fair distribution of products and single cards. Consumers may not purchase the entire stock of a product with the intent to extract the best items and return the rest. If this occurs, Cards Center may deduct 15% from the refund.
Shipping Costs
If a consumer exercises their right of withdrawal and returns the order, Cards Center will not refund the shipping costs.
Return Costs
If a consumer returns the entire order under their right of withdrawal, the return costs are borne by the consumer.
Right of Suspension
Unless the customer is a consumer, they waive the right to suspend any obligations arising from the agreement.
Right of Retention
Cards Center may retain the customer’s products until all outstanding payments are settled, unless sufficient security is provided.
This right also applies to prior agreements where the customer owes payments to Cards Center.
Cards Center is not liable for any damages resulting from exercising this right.
Set-Off
Unless the customer is a consumer, they waive the right to set off any debt owed to Cards Center against claims on Cards Center.
Retention of Title
Cards Center retains ownership of delivered products until the customer has fully paid all amounts due under any agreement with Cards Center, including claims for non-performance.
Until then, Cards Center may reclaim the products.
The customer may not pledge, sell, transfer, or otherwise encumber the products before ownership transfers.
If Cards Center exercises its retention of title, the agreement is considered terminated, and Cards Center may claim damages, lost profits, and interest.
Delivery
Delivery is subject to availability.
Delivery occurs at Cards Center’s location unless otherwise agreed.
Online orders are delivered to the address specified by the customer.
If agreed payments are not made on time, Cards Center may suspend delivery until payment is received.
Late payment constitutes creditor default, and the customer cannot hold Cards Center liable for delayed delivery.
Missing Items
If missing items have an individual value of €13.50 or more, or if multiple missing items total €13.50 or more, the customer is eligible for a replacement shipment, sent via tracked mail.
If the value is below €13.50, a refund will be issued instead.
Delivery Time
Estimated delivery times provided by Cards Center are indicative and do not entitle the customer to termination or compensation unless explicitly agreed in writing.
The delivery period begins when the customer completes the (electronic) order process and receives confirmation from Cards Center.
Exceeding the estimated delivery time does not entitle the customer to compensation or termination unless Cards Center fails to deliver within 14 days of a written notice or unless otherwise agreed.
Actual Delivery
The customer must ensure timely receipt of ordered products.
Transport Costs
Transport costs are borne by the customer unless otherwise agreed.
Packaging and Shipping
If the packaging of a delivered product is opened or damaged, the customer must note this with the shipper before accepting the product. Failure to do so absolves Cards Center of liability for damages.
If the customer arranges transport, they must report visible damage to the product or packaging beforehand; otherwise, Cards Center is not liable for damages.
Storage
If the customer delays pickup beyond the agreed delivery date, the risk of quality deterioration lies entirely with the customer.
Additional costs due to early or late pickup are the customer’s responsibility.
Warranty
Warranty covers defects caused by faulty manufacturing, construction, or materials. Misprints, miscuts, or other defects caused by The Pokémon Company’s production are not covered by Cards Center’s warranty and must be reported directly to The Pokémon Company.
Warranty does not cover normal wear and tear, accidents, modifications, negligence, improper use, or unclear defect causes. The customer must store purchased products properly.
The risk of loss, damage, or theft transfers to the customer upon delivery or when the product comes under their control or that of a third party.
Exchanges
Exchanges are only permitted if:

The exchange occurs within 14 days of purchase with the original invoice.

The product is returned in its original packaging with the seal intact and no visible signs of use.

The product has not been used.
Discounted items, bundle products, second-hand single cards, mystery boxes, and gift cards cannot be exchanged.
Indemnification
The customer indemnifies Cards Center against all third-party claims related to delivered products or services.
Responsibility for Undelivered Packages
If a package is marked as delivered but not received, the customer must report this within 24 hours to the courier and Cards Center via [this link](insert link).
Claims must be filed within 10 days of the marked delivery date. Failure to do so voids any investigation or claim, and Cards Center is no longer responsible.
Complaints
Consumers must first address complaints to Cards Center. If unresolved, they may contact Stichting WebwinkelKeur (www.webwinkelkeur.nl) for mediation. If mediation fails, the consumer may escalate to the independent disputes committee, whose decision is binding. Costs apply. Complaints may also be filed via the EU ODR platform.
The customer must inspect delivered products promptly for defects.
If a product or service does not meet expectations, the customer must notify Cards Center within 24 hours (48 hours for consumers) with a detailed description.
The customer must prove the complaint relates to an agreement with Cards Center.
Complaints about ongoing work do not obligate Cards Center to perform additional services.
If dissatisfied, the customer must inform Cards Center promptly for an informal resolution.
If unresolved, the customer may file a complaint with WebwinkelKeur’s disputes committee.
If a complaint is justified, Cards Center will, at its discretion, replace or repair the product free of charge.
Notice of Default
The customer must communicate notices of default to Cards Center in writing.
The customer is responsible for ensuring the notice reaches Cards Center on time.
Joint Liability
If Cards Center enters an agreement with multiple customers, each is jointly liable for all amounts owed under the agreement.
Liability of Cards Center
Cards Center is only liable for damages caused by intent or gross negligence.
Liability is limited to direct damages arising from the agreement.
Cards Center is never liable for indirect damages, such as consequential loss, lost profits, or third-party damages.
Liability is capped at the amount covered by professional liability insurance or, if uninsured, the relevant invoice amount.
Images, photos, colors, and descriptions on the website or catalog are approximate and do not entitle the customer to compensation or termination.
Statute of Limitations
Any claim for damages against Cards Center expires 12 months after the event giving rise to the liability, without prejudice to Article 6:89 of the Dutch Civil Code.
Right to Terminate
The customer may terminate the agreement if Cards Center fails to meet its obligations, unless the failure is minor.
Termination is only possible after Cards Center is in default if performance is permanently or temporarily impossible.
Cards Center may cancel orders if pricing errors are detected to its detriment.
Cards Center may terminate the agreement if the customer exploits pricing errors or fails to meet obligations.
Cards Center may terminate the agreement if the customer engages in intimidation or abuse (e.g., offensive language).
Force Majeure
Beyond Article 6:75 of the Dutch Civil Code, force majeure includes emergencies (e.g., war, natural disasters), supplier failures, utility outages, strikes, government measures, transport issues, and work stoppages.
In case of force majeure, obligations are suspended until performance is possible.
If force majeure lasts 30+ days, either party may terminate the agreement in writing.
Cards Center owes no compensation for force majeure, even if it benefits from the situation.
Agreement Amendments
If amendments are needed after the agreement is formed, parties will adjust the agreement in mutual consultation.
This does not apply to in-store purchases.
Changes to Terms and Conditions
Cards Center may modify these terms at any time.
Minor changes may be implemented immediately.
Substantial changes will be discussed with the customer in advance.
Consumers may terminate the agreement if terms are materially changed.
Transfer of Rights
The customer may not transfer rights under the agreement without Cards Center’s prior written consent.
This clause has proprietary effect under Article 3:83(2) of the Dutch Civil Code.
Invalidity
If any provision is invalid or voidable, the remaining provisions remain in effect.
The invalid provision will be replaced by one closest to Cards Center’s original intent.
Governing Law and Jurisdiction
Dutch law governs all agreements between parties.
The Dutch court in Cards Center’s jurisdiction has exclusive authority over disputes, unless mandatory law dictates otherwise.
